Sunshine Week also culminates in the annual Freedom of Information Day, celebrated on March 16. As a FOIA expert, I can’t let this moment pass without reflecting on FOIA’s history and its ever-increasing importance in today’s world.
A Brief History of FOIA
Enacted in 1967, FOIA was a landmark piece of legislation. It established a right for every person to access information held by the federal government. It empowers citizens to hold their elected officials accountable, understand government decisions, and participate more meaningfully in the democratic process.
FOIA’s Growing Importance in Data Discovery
In the context of data discovery, Sunshine Week takes on a particular relevance for government agencies. FOIA is a cornerstone of open government, allowing citizens to request access to information held by federal agencies. As the volume of electronically stored information (ESI) — documents, emails, databases — has exploded in recent years, so too has the burden of responding to FOIA requests.

The Latest Stats on FOIA Requests

To put that in perspective, between 1967 and 1971 — the first four years the FOIA was in effect — the Justice Department received only 535 FOIA requests.
The numbers don’t lie: 74% of agencies reported an increase in FOIA requests, with over half experiencing a rise of at least 20%. While the overall backlog remained relatively stable at the end of FY 2023, over 200,000 requests still await processing — a testament to the resource-intensive nature of responding to FOIA requests.
The number of FOIA personnel also saw a slight decrease in 2023, dropping to 4,943. This translates to roughly one FOIA officer for every 243 requests, a significant workload for such a dedicated team. Additionally, FOIA processing and litigation costs reached an all-time high of $669 million in FY 2023, highlighting the financial strain on agencies in fulfilling FOIA requests.

Despite these challenges, the ever-increasing volume of FOIA requests can also be seen as a positive sign. It signifies a public engaged in the democratic process, actively seeking information and holding their government accountable.
